A few techniques that we use to deliver timely, 'tunable' analysis include:
Co-Citation Patent Analysis
Co-Citation Analysis identifies patents that cite the same prior patent art as the patent we are trying to invalidate (the "Target Patent").
Same Patent Class Analysis
We work through all patents that are in the same class pair and in the USPTO hierarchical class pairs of the Target Patent, that also meet the priority date requirements, and filter down the candidate sets by the number of keywords matched for manual review.
Same Patent Examiner Analysis
We review all patents by the same examiner of the Target Patent, that also meet the priority date requirements, and filter down the candidate sets by the number of keywords matched for manual review.
Three Deep Patent Analysis
When a technology landscape is developing it often takes a while for the "lexicon" to settle down to generally accepted terms. In these situations keyword searching may have significant limitations. For this and other reasons we run a "Three Deep Analysis".
Structured Patent Review
The narrowed set of candidate patents is then reviewed manually for relevance as prior art influencing patent validity and invalidity determination, reexamination and litigation settlement.
